These Terms of Use ("Terms") govern your use of the Metro Sound application ("the app"), provided by Next Horizon Technologies Inc. ("we", "us"). By downloading or using the app, you agree to these Terms.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use, subject to these Terms and the rules of the app store through which you obtained it.

Your content & rights

Metro Sound lets you import audio tracks and photos from your own device. You are solely responsible for ensuring you have the right to use any audio, recordings, or images you import. You must only import content you own or are otherwise permitted to use. Your imported content remains yours; it is stored on your device and, if you enable sync, in your own cloud account.

Acceptable use

You agree not to use the app to infringe anyone's intellectual property rights, and not to misuse the app, including attempting to reverse engineer or interfere with it, or using it in violation of any applicable law.

Third-party services

If you enable sync, the app integrates with Google Drive. Your use of Google services is subject to Google's own terms and privacy policy. We are not responsible for third-party services.

Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, that tuning or tempo will be perfectly accurate, or that data will never be lost.

Limitation of liability

To the maximum extent permitted by law, Next Horizon Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or content, arising out of your use of the app.

Termination

You may stop using the app at any time by deleting it. We may suspend or discontinue the app, in whole or in part, at any time.

Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the app constitutes acceptance of the updated Terms.
